1. Provider and Scope

These Terms of Use apply to the iOS application Beat Motion Studio (hereinafter "App"), provided by Pondstack Software, represented by Jürgen Frosch, Segeberger Chaussee 162, 22851 Norderstedt, Germany (hereinafter "Provider").

By downloading, installing, or using the App, you agree to these Terms of Use.

2. Description of the App

Beat Motion Studio is a native iOS app for automatically creating beat-synchronized video mixes. The App analyzes video and music locally on the device, cuts video clips precisely to the beat of the selected song, and exports the result as an MP4 file.

The App requires iOS 17.0 or later; iOS 18 is recommended. It is available for iPhone and iPad. An internet connection is required for downloading and in-app purchases via the Apple App Store; the actual video creation works entirely offline on the device.

The Provider reserves the right to modify, update, or discontinue individual features of the App at any time, provided this does not breach material contractual obligations. Updates are provided free of charge via the App Store.

Beat Motion Studio offers optional in-app purchases via the Apple App Store (Non-Consumable, one-time purchase):

Prices may vary by App Store region. The displayed price applies at the time of purchase. Payment is processed through Apple; Pondstack Software does not receive any payment data from the user.

In-app purchases are permanently linked to the user's Apple ID. Previously purchased items can be reactivated via "Restore Purchases" in the App.

Family Sharing: All purchases support Apple Family Sharing.

6. Refunds for In-App Purchases

In-app purchases are processed through Apple. Refund rights are governed by Apple's App Store Terms and Conditions. Refund requests must be directed to Apple directly (Settings → Apple ID → Subscriptions and Purchases, or via reportaproblem.apple.com).

Since in-app purchases in Beat Motion Studio are permanently unlockable Non-Consumable products (not subscriptions), the statutory right of withdrawal may be deemed waived once the digital content has begun executing upon the user's explicit consent and the user has confirmed the loss of the right of withdrawal.

7. Copyright and Usage Rights

The App and all its contents — including code, design, graphics, animations, the Beat Motion Studio logo, and the outro sound effect — are protected by copyright and are the property of Pondstack Software.

The Provider grants the user a simple, non-transferable right to use the App for personal and commercial purposes as described in these terms. Resale, licensing to third parties, decompilation, reverse engineering, or modification of the App is prohibited.

8. User Content and Third-Party Copyright

The user is solely responsible for ensuring that the video and audio content used in the App is legally permissible. Beat Motion Studio accesses videos and music stored on the user's device.

The Provider accepts no liability for copyright infringements resulting from the user's use of protected content. In particular, the user bears the risk when publishing exported videos containing music tracks for which they do not hold the necessary rights.

9. BMS Music – Royalty-Free Music Library

Beat Motion Studio provides a curated library of royalty-free music tracks from independent labels within the App (hereinafter "BMS Music"). BMS Music is hosted on the Provider's own servers and made available exclusively within the App for streaming and download.

9.1 License Scope

By using BMS Music, the user is granted a simple, non-transferable, revocable license exclusively for private, non-commercial purposes. The license is valid worldwide and unlimited in time, as long as the App is installed and these Terms of Use are complied with.

9.4 Attribution (Credit)

Exported videos containing BMS Music automatically include an attribution overlay showing the artist and label name (credit). This attribution must not be removed, obscured, or made illegible.

9.5 Availability and Changes

The Provider reserves the right to modify, expand, or remove individual tracks from the BMS Music library at any time. There is no entitlement to the permanent availability of specific music tracks. Videos already exported remain unaffected by any removal from the library.

9.6 Usage Confirmation

Before using BMS Music for the first time, the user must confirm the terms of use for the music library within the App. Without this confirmation, selecting and using BMS Music tracks is not possible.

10. Instagram and Social Media Sharing

The sharing feature for Instagram and other platforms uses URL schemes and system APIs provided by those platforms. When publishing content on third-party platforms, the terms of use and community guidelines of the respective platform also apply. Pondstack Software has no influence over the distribution of content after sharing.

11. Limitation of Liability

The Provider is liable without limitation for damages arising from injury to life, body, or health, as well as for intentional or grossly negligent conduct. Otherwise, the Provider's liability is limited to foreseeable, typical contractual damages.

The Provider does not warrant that the App will be available without interruption or error at all times. Liability for data losses caused by incorrect device configuration or external causes is excluded.

The App processes all data locally on the user's device. The Provider accepts no liability for loss of project data or exported videos caused by device loss, system errors, or iOS updates.

12. Technical Support

Support requests can be sent by email to info@pondstack.com. There is no entitlement to a specific response time. The Provider endeavors to process requests promptly.

13. Changes to the Terms of Use

The Provider reserves the right to update these Terms of Use in the event of significant changes to the App or legal requirements. Users will be notified of material changes. Continued use of the App after a change constitutes acceptance of the updated terms.

14. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers within the EU, the mandatory consumer protection provisions of the member state in which the consumer resides shall apply where they are more favorable.

The place of jurisdiction for all disputes arising from or in connection with these Terms of Use is, to the extent permitted by law, Hamburg, Germany.

15. EU Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. Pondstack Software is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Severability Clause

If any provision of these Terms of Use is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
