2. Right of Withdrawal
As a consumer within the European Union, you have the right to withdraw from a contract for digital content within 14 days of the date of purchase, without giving any reason, in accordance with EU Consumer Rights Directive 2011/83/EU.
3. Exceptions for Digital Content
Under EU law (Directive 2011/83/EU, Art. 16(m)), the right of withdrawal expires for digital content not delivered on a physical medium if:
- performance has begun with the consumer's prior express consent, and
- the consumer acknowledged that they lose their right of withdrawal once performance begins.
Where a download is made available immediately after purchase and the user has explicitly consented to immediate delivery and loss of the right of withdrawal, the right of withdrawal may no longer apply.
4. Purchases via the Apple App Store
Purchases of Pondstack apps through the Apple App Store (TrackHound, BPM Scout, Spin Deck Studio, CrowdDrop) are processed exclusively by Apple. Apple's own refund policy applies to these purchases:
- EU consumers are entitled to a 14-day return window for App Store purchases.
- Refund requests must be submitted directly to Apple at: reportaproblem.apple.com
- Pondstack Software has no influence over Apple's refund decisions.
5. Direct Downloads via Paddle
Direct downloads (currently: DJReport) are processed through Paddle as Merchant of Record. Paddle acts as the legal seller and is responsible for payment processing and compliance with applicable refund obligations.

- Paddle processes refunds in accordance with their own policies and applicable legal requirements.
- Once a download has been initiated and the user has expressly consented to immediate performance, the right of withdrawal may have expired under applicable law.
6. Free Software (SlippyClean)
SlippyClean is completely free of charge. As no purchase contract is entered into, the right of withdrawal does not apply. Voluntary donations do not constitute a contractual relationship and are non-refundable.
7. How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal (for direct Paddle purchases), please send a clear written statement (e.g. by email) stating your decision to withdraw from the contract:

To meet the withdrawal deadline, it is sufficient to send your notice of withdrawal before the 14-day period expires.
8. Consequences of Withdrawal
If you validly withdraw from a contract, we (or Paddle as Merchant of Record) will refund all payments received from you promptly, and in any case within 14 days of the day on which we received your withdrawal notice, using the same means of payment as used for the original transaction.
