§ 1 Provider

§ 2 Subject Matter

The subject matter is the provision of software products (DJReport, TrackHound, BPM Scout, SlippyClean, CrowdDrop, Spin Deck Studio, RekordTidy). Depending on the product, the software serves for DJ setlist creation, music tempo detection, track identification, or system maintenance. Where lists or reports are generated, this is done based on the current requirements of collecting societies, in particular GEMA. No guarantee is given for the recognition or legal validity of individual submissions.

§ 3 Independence / Trademark Notice

Pondstack Software products operate independently and have no economic or organizational connection with Rekordbox, Serato DJ, GEMA, or other named brands.

§ 4 Contract Formation / Apple

Purchases are made via the Apple App Store. Apple is not a contracting party for software use. Subscription management is handled exclusively through Apple.

§ 5 Data Backup Obligation

The user is obliged to create adequate backup copies of their databases, music libraries, and project files before using the software.

§ 6 Liability

The following liability rules apply:

• Unlimited liability for intent, gross negligence, and personal injury
• Limited liability for slight negligence affecting material contractual obligations
• Liability for data loss is limited to restoration costs in the event of proper data backup
• Excluded: indirect damages (lost profits, cancelled events, reputational damage)
• No liability for format changes by third-party software or faulty exports

§ 7 Warranty

Statutory warranty rights for digital products apply. Future compatibility with third-party software is not guaranteed.

§ 8 Applicable Law

German law applies. Mandatory consumer protection provisions remain unaffected.
