1. Provider and Scope

These Terms of Use apply to the macOS application SlippyClean (hereinafter "App"), provided by Pondstack Software, represented by Jürgen Frosch, Segeberger Chaussee 162, 22851 Norderstedt, Germany (hereinafter "Provider").

By downloading, installing, or using the App, you agree to these Terms of Use. Prior to the first download, you must also accept the Disclaimer presented on the download page.

2. Subject Matter and Description

SlippyClean is a native macOS application for system optimization and storage cleanup. The App analyzes the local file system and helps users find and remove unnecessary files, temporary data, caches, and other system files to free up storage space.

The application includes the following modules:

• System Scout – System overview and storage analysis
• Caches & Temporary Files – Detection of app caches and temp data
• Trash & Downloads – Analysis of Trash and Downloads folder
• Large Files – Identification of particularly large files
• Duplicates – Search for duplicate files based on checksums
• App Leftovers – Residual files from uninstalled applications
• Mail Attachments – Locally stored email attachments
• Screenshots & Screen Recordings – Older desktop captures
• Developer Tools – Build artifacts, simulators, Node Modules, Docker
• System Logs & Crash Reports – System logs and crash reports
• iOS Backups & Software Updates – iTunes/Finder backups, IPSW files
• Fonts – Unused font files
• Localization Files – Unnecessary language files from installed apps
• Browser Data – Caches and history from popular browsers
• Old Time Machine Snapshots – Local Time Machine snapshots

Please note: The App's user interface is currently available in German only. The Provider reserves the right to modify, expand, or reduce the functionality of the App through updates.

3. Free Availability

SlippyClean is provided free of charge. No license fees, subscriptions, or other charges apply. The App is not available through the Mac App Store, but exclusively as a direct download from pondstack.com/slippyclean.

The Provider reserves the right to change this free offering in the future or to introduce a freemium model. Material changes will be announced on the download page at pondstack.com/slippyclean.

4. License and Restrictions

The Provider grants you a non-exclusive, non-transferable, revocable license to use SlippyClean on your own Apple computers running macOS. You are expressly prohibited from:

• Copying, distributing, or making the App available to third parties
• Attempting to obtain the source code through reverse engineering, decompilation, or disassembly
• Modifying the App, creating derivative works, or renting it out
• Removing or altering copyright notices, protection marks, or other labels
• Using the App for any unlawful purposes

5. System Requirements and Permissions

The following requirements must be met to use SlippyClean:

• Operating System: macOS 14 Sonoma or later
• Architecture: Apple Silicon (M1 or later) or Intel (64-bit)
• Permission: Full Disk Access in macOS System Settings

Full Disk Access is required for the App to analyze all relevant system directories. Without this permission, the App's functionality is significantly limited. You grant this permission at your own discretion via macOS System Settings.

SlippyClean does not connect to the internet and does not transmit any data to the Provider or third parties.

6. User Obligations

You agree to:

• Use the App only for lawful purposes
• Ensure a complete, up-to-date backup of your system exists before using the App
• Carefully review files suggested by the App for deletion before confirming removal
• Only use the App on systems over which you have full administrative control
• Not analyze or delete other people's data without their explicit consent

7. Data Backup Obligation

You are expressly and solely responsible for creating a complete backup of your system before each use of SlippyClean. SlippyClean enables the permanent deletion of system files that cannot be recovered.

Recommended backup methods:

• Time Machine to an external hard drive or network storage
• iCloud backup for personal documents
• Third-party backup software (e.g., Carbon Copy Cloner, SuperDuper)

The Provider is not liable for data loss resulting from missing, incomplete, or faulty backups. This is also addressed in the Disclaimer that you accept before downloading.

8. Disclaimer of Liability

In addition to these Terms of Use, the separate Disclaimer applies, which you expressly accept before downloading. The key points are:

• SlippyClean analyzes and deletes system files. Errors may lead to data loss or system instability.
• The Provider assumes no liability for damages arising from use of the App.
• You bear sole responsibility for reviewing and confirming files selected for deletion.
• Some operations are irreversible. Deleted files cannot be recovered.
• The App may not be used on systems over which you do not have full administrative control.
• The Provider assumes no liability for failures, malfunctions, or incompatibilities with specific macOS versions or hardware configurations.

8.1 Unlimited Liability: The Provider's liability is unlimited for intentional misconduct and gross negligence, under product liability law, and for injury to life, body, or health.

8.2 Limited Liability: In cases of ordinary negligence, the Provider is only liable when a material contractual obligation (cardinal duty) is breached. In such cases, liability is limited to foreseeable, typical contractual damages.

8.3 Exclusions: To the extent permitted by law, the Provider is not liable for:

• Data loss due to missing or insufficient backups
• System instability or failure after cleanup operations
• Errors in file classification by the App
• Compatibility issues with future macOS versions or third-party software
• Unintended deletion of files whose removal was explicitly confirmed by the user
• Indirect damages, lost profits, or consequential damages in cases of ordinary negligence

9. Warranty

Statutory warranty rights for digital products under German law apply to the extent the App is not provided free of charge. Where the App is provided free of charge, the statutory warranty is limited to cases where the Provider has fraudulently concealed a defect.

The Provider does not warrant that the App will be free of errors or available without interruption, or that it will be suitable for the user's specific purposes.

10. Updates

The Provider will make updates available to the extent technically and economically feasible. There is no entitlement to specific updates, new features, or the resolution of particular bugs. The Provider may discontinue support for older macOS versions with new updates.

Updates may change the scope of functionality. Material functional changes will be communicated on the download page.

11. Termination and Uninstallation

The license to use the App terminates automatically if you violate these Terms of Use. Upon termination, you are obligated to remove all copies of the App from your systems.

Uninstallation is performed by deleting the application from the macOS Applications folder. Remaining configuration files can then be removed manually or using a suitable uninstallation tool.

12. Changes to Terms of Use

The Provider reserves the right to update these Terms of Use upon material changes to the App or the applicable legal framework. The current version is always available at pondstack.com/slippyclean-terms. Material changes that significantly affect user rights will be communicated on the download page. If you do not agree to any changes, you may discontinue use and uninstall the App.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country where you ordinarily reside remain unaffected.

To the extent permitted by law, the place of jurisdiction is Hamburg, Germany.

14. Severability

If any provision of these Terms of Use is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
